The concise answer

French tax residence is not determined by a single “183 days” shortcut. French domestic law uses several possible connections, including where your household or home is located, your principal place of stay, your principal professional activity, and the center of your economic interests.

Immigration status and tax residence are different legal questions. A person can have an immigration authorization without that document deciding every tax issue.

The French domestic criteria

The French Tax Authority identifies multiple criteria. Depending on the facts, residence can turn on:

  • the household or home in France;
  • the principal place of stay;
  • a principal professional activity in France; or
  • the center of economic interests in France.

Day counting can matter, but it does not replace the complete factual analysis.

Why immigration status is not the answer

A visa or residence permit answers immigration questions. Tax residence concerns fiscal connecting factors. The label on an immigration document should not be treated as a complete tax-residence determination.

The U.S.–France treaty boundary

France and the United States maintain an income-tax treaty framework. If both countries’ domestic rules treat a person as resident, treaty analysis may become relevant and tie-breaker concepts may need to be considered.

This page does not determine an individual treaty position. It does not advise on foreign tax credits, income allocation, entities, investments, pensions, estate or gift tax, FBAR, FATCA, or filing strategy. U.S. citizens generally retain U.S. federal filing obligations even while living abroad, but the application to a particular household requires qualified cross-border tax advice.

Plan before the move

Map household location, days, work, business interests, income, accounts, entities, investments, and the expected moving timeline before obligations arise. This is general educational information, not individualized tax, legal, financial, or treaty advice.
